Terms of Service

Terms and Acceptable Use Policy governing developer usage, AI agent tool calls, and platform infrastructure.

Agentic Tool Calls

You are responsible for all MCP tool calls, database migrations, and deployments initiated by AI agents connected to your account.

100% Code Ownership

You retain complete intellectual property ownership over all application code, database schemas, and data deployed on ProductEcho.

Acceptable Use Policy

Crypto mining, malicious DDoS generation, malware deployment, or unauthorized network scanning is strictly prohibited.

1. Acceptance of Terms

By creating a ProductEcho account, installing our Model Context Protocol (MCP) server, or accessing our runtime infrastructure, you agree to be bound by these Terms of Service ("Terms") and all applicable laws and regulations.

If you are agreeing to these Terms on behalf of a company or legal entity, you represent and warrant that you have full legal authority to bind that entity to these Terms.

2. Service Description & Agentic Execution

ProductEcho provides an automated AI-native runtime platform, including instant PostgreSQL database provisioning, container orchestration, HTTPS domain assignment, and MCP tool interfaces.

Important Note on AI Agent Interactions:

When you connect ProductEcho to an AI assistant (such as Claude, Cursor, or ChatGPT) via Model Context Protocol, the AI agent acts under your explicit authorization. Any infrastructure provisioned, code executed, or database modified via MCP tool calls is deemed to be performed directly by you.

3. Acceptable Use Policy (AUP)

You agree not to use ProductEcho services for any prohibited activities, including but not limited to:

Deployment of malware, ransomware, botnets, or phishing applications.
Cryptocurrency mining or compute-intensive proof-of-work processes.
Automated denial-of-service (DDoS) attacks, network port scanning, or vulnerability exploitation.
Hosting illegal content or violating third-party privacy or intellectual property rights.

4. Intellectual Property & Code Ownership

You retain 100% ownership of all source code, software artifacts, database schemas, and content deployed to your ProductEcho runtimes. ProductEcho claims no ownership rights over your software or AI-generated applications.

ProductEcho retains all right, title, and interest in and to our core platform, underlying container orchestration technology, dashboard UI, and MCP server implementations.

5. Uptime Target & Service Availability

ProductEcho targets 99.9% uptime for production container runtimes and database services. Scheduled maintenance windows will be communicated in advance whenever feasible.

6. Limitation of Liability

To the maximum extent permitted by law, ProductEcho Platform Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or application downtime resulting from your use of or inability to use our services.
